Agreement to Terms

By downloading, installing, or using HookID (the "App"), published by Brainstorm Innovative Technologies LLC ("HookID," "we," "us"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.

Important — Read Before Use

HookID is provided strictly for informational and general reference purposes only. Nothing in this App constitutes legal advice, a guarantee of regulatory compliance, or a warranty of accuracy.

No Liability for Misidentification

Fish species identification performed by HookID relies on artificial-intelligence image-recognition technology and publicly available reference data, neither of which is infallible. HookID, its developers, officers, affiliates, agents, and licensors expressly disclaim all liability — whether direct, indirect, incidental, consequential, special, or punitive — arising from any misidentification of a fish species, including without limitation any fines, citations, penalties, legal proceedings, loss of fishing privileges, property damage, or personal injury that may result from reliance on identification results generated by the App.

Regulations Change

Fishing regulations, size limits, bag limits, and seasonal closures are established and amended by state and federal agencies on an ongoing basis. Regulation data displayed within the App is sourced from publicly available information and may not reflect the most current rules in effect. HookID makes no representation that the regulatory information displayed is complete, accurate, current, or applicable to any specific location, water body, or fishing situation. You are solely responsible for verifying current applicable regulations with the relevant authority before retaining any fish.

Your Responsibility

It is the sole responsibility of each user to know, understand, and comply with all applicable federal, state, and local fishing laws and regulations. Reliance on the App as a substitute for independent verification of fishing regulations is done entirely at your own risk.

The free version of the App is supported by advertising served by third-party ad networks (currently Google AdMob) in two forms: a small banner anchored above the tab bar throughout the free version of the App, and an optional rewarded video that unlocks a fish identification. In the free version, your first identification after installing is free; after that, each identification is unlocked either by watching one rewarded video or by subscribing to HookID Pro. A rewarded video is never played automatically — it starts only when you choose to watch it, and you may close it at any time; closing it early simply means no identification is unlocked, and you are offered the choice again. If an ad cannot be shown for any reason — no ad available, no connection, or advertising consent not resolved — the App performs the identification anyway.

Advertisements are clearly distinguishable from App content. We do not endorse, and are not responsible for, the content of third-party advertisements or the products and services they promote; your interactions with an advertiser are solely between you and that advertiser. Data practices related to advertising are described in our Privacy Policy. Subscribing to HookID Pro removes all advertising from the App, including the rewarded videos and the requirement to watch one.

HookID Pro Subscription

HookID offers an optional auto-renewing subscription, HookID Pro, which unlocks additional features (including the catch journal and marine weather), gives unlimited fish identifications, and removes all advertising. HookID Pro is offered as a monthly plan and a discounted annual plan; current U.S. prices are $2.99 per month and $19.99 per year, and the price and billing period that apply to you are shown in the App at the point of purchase, in your local currency. Both plans unlock the same features. Fish identification and Florida regulation reference remain available without a subscription — regulation reference in full, and identification through the ad-supported model described under "Advertisements" above.

Fair use. "Unlimited" identifications means we place no per-user quota on identifications for subscribers. To keep the service available and to protect it from abuse, we apply ordinary rate limiting and abuse protections at the server, which may briefly slow or pause identification requests in the event of automated, abusive, or extraordinarily high-volume use. Normal personal fishing use is not affected.

Auto-renewal. Payment is charged to your Apple App Store or Google Play account upon confirmation of purchase. The subscription automatically renews for the same period at the then-current price unless it is canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.

Managing and canceling. You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Canceling stops future renewals; it does not retroactively refund the current period. Deleting the App does not, by itself, cancel your subscription.

Refunds. All payments are processed by Apple and Google, and refunds are governed by their respective policies. We do not process payments or store your payment-card information. To request a refund, contact the applicable store (Apple: reportaproblem.apple.com; Google Play: your Play Store order history).

Changes. We may change subscription pricing or which features require a subscription on a going-forward basis, with notice in the App or on this site; price changes apply to renewals after the notice period required by the applicable app store.

Intellectual Property

HookID and all content, features, and functionality — including but not limited to text, graphics, logos, and software — are owned by Brainstorm Innovative Technologies LLC and its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission. Fish identification is powered by Fishial.AI under the MIT License; species photos are sourced from Wikipedia and Wikimedia Commons under each image's individual license, as displayed in the App. Those photos load directly from Wikimedia's servers — see the Privacy Policy for what that means for your data.

Disclaimer of Warranties

HookID is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by applicable law, HookID and its developers shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or data, arising out of or related to your use of, or inability to use, the App. To the maximum extent permitted by law, our total cumulative liability for any claim shall not exceed the greater of (a) the total subscription fees you paid to us through the applicable app store in the twelve (12) months before the event giving rise to the claim, or (b) twenty U.S. dollars (US $20).

Indemnification

You agree to indemnify, defend, and hold harmless HookID, Brainstorm Innovative Technologies LLC, and their developers, officers, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising from your use of the App, your violation of these Terms, or your violation of any applicable law or regulation.

Acceptable Use

You agree that you will NOT use HookID to circumvent, ignore, or violate any federal, state, or local fishing laws; retain, harvest, or possess any fish based solely on identification results without independently verifying applicable regulations; reverse-engineer, decompile, or exploit any component of the App; interfere with or disrupt the App's services or servers; use the App for any fraudulent, harmful, or illegal purpose; or represent identification results as legally authoritative determinations.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida and the Federal Arbitration Act, without regard to conflict-of-law provisions. Except for Disputes subject to arbitration below, the state and federal courts located in Florida shall have exclusive jurisdiction.

Dispute Resolution; Binding Arbitration

Please read this section carefully — it affects your legal rights. You and Brainstorm Innovative Technologies LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App (a "Dispute") will be resolved by binding individual arbitration, rather than in court, except that either party may bring a qualifying claim in small-claims court. The Federal Arbitration Act governs the interpretation and enforcement of this provision.

Informal resolution first. Before initiating arbitration, you agree to first contact us at support@hookid.app and allow 30 days to resolve the Dispute informally.

Arbitration process. The arbitration will be administered by a recognized arbitration provider under its consumer arbitration rules. It will be conducted in the State of Florida or, at your election, by telephone, video, or written submissions. The arbitrator's award is final and may be entered as a judgment in any court of competent jurisdiction.

30-day opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@hookid.app with your name and a statement that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.

Class-Action Waiver

To the maximum extent permitted by law, you and HookID agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall be severed and brought in court.

Modifications

We reserve the right to modify these Terms at any time. Updates will be reflected on this page and in subsequent App versions. Continued use constitutes acceptance of any modifications.
